FAKE! The Counterfeit Microchips Industry in China – How it Works, and How to Fight it
The most expensive part of bringing an electronic product to market is R&D, followed by quality maintenance through production. We visit China frequently. Just like anyone else, we always have an eye on competitor offerings. Lately, especially in cost-sensitive markets, we observe a new trend. We not only compete with genuine competitors from Europe or the US but also with Chinese copies of their products, which undersell the actual manufacturers substantially. Chinese government increased the efforts to fight deceptive counterfeits. Fighting patents infringed by non-deceptive counterfeits still is much harder. The paper provides insights into the Chinese counterfeit microchip industry. It discloses how products are cloned and discusses options to fight violators on a legal base directly and through their customers€™ products. The paper also describes technical countermeasures, all based on a real-world example on the process of a patent infringement case for a foreign company in China.
